This document (as well as other documents mentioned herein) regulates the conditions governing the use of this Web Site (www.chachara.se) and the purchase or acquisition of products and/or services on it (hereinafter, Conditions).

For the purposes of these Conditions it is understood that the activity that Cháchara develops through the Web Site includes:

Marketing and distribution of face-to-face and online Spanish classes in Sweden.

In addition to reading these Conditions, before accessing, browsing and/or using this website, the User must have read the Legal Notice and the General Conditions of Use, including, the cookies policy, and the privacy and data protection policy of Cháchara. By using this Web Site or by making and/or requesting the acquisition of a product and/or service through it, the User agrees to be bound by these Conditions and by all the aforementioned, so if he/she does not agree with all of them, he/she should not use this Web Site.

Likewise, it is informed that these Conditions may be modified. The User is responsible for consulting them each time he/she accesses, navigates and/or uses the Website, since those in force at the time the purchase of products and/or services is requested will be applicable.

For all questions that the User may have regarding the Conditions, he/she may contact the owner using the contact details provided above or, if applicable, using the contact form.

2. THE USER

The access, navigation and use of the Web Site, confers the condition of user (hereinafter referred to, indistinctly, individually as User or jointly as Users), so they accept, from the moment they start browsing the Web Site, all the Conditions set forth herein, as well as its subsequent modifications, without prejudice to the application of the corresponding legal regulations of mandatory compliance as appropriate.

The User assumes responsibility for the correct use of the Website. This responsibility shall extend to:

  • Use this Web Site only to make inquiries and legally valid purchases or acquisitions.
  • Do not make any false or fraudulent purchases. If it could reasonably be considered that such a purchase has been made, it may be cancelled and the relevant authorities will be informed.
  • Provide truthful and lawful contact details, e.g. e-mail address, postal address and/or other data (see Legal Notice and General Conditions of Use).

The User declares to be over 18 years of age and to have legal capacity to enter into contracts through this Web Site.

The User will be able to formalize, at his choice, with Cháchara the contract of sale of the desired products and/or services in any of the languages in which the present Conditions are available in this Web Site.

3. PURCHASE OR ACQUISITION PROCESS

Duly registered Users may purchase on the Website by the means and in the manner established. They should follow the online purchase and/or acquisition procedure of www.chachara.se, during which several products and/or services can be selected and added to the cart, basket or final purchase space and, finally, click on: “I want to sign up for this course”.

Likewise, the User must fill in and/or check the information requested at each step, although, during the purchase process, before making the payment, the purchase data can be modified.

Subsequently, the User will receive an email confirming that Cháchara has received his order or request for purchase and/or provision of the service, that is to say, the confirmation of the order. And, in his case, he will be informed, likewise, by e-mail when his purchase is being sent.

The User acknowledges being aware, at the time of purchase, of certain particular conditions of sale concerning the product and/or service in question, and

The communications, purchase orders and payments that intervene during the transactions carried out on the Website could be archived and kept in the computerized records of Cháchara in order to constitute a means of proof of the transactions, in any case, respecting the reasonable conditions of security and the laws and regulations in force that in this regard are applicable, and particularly in compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and the free movement of such data (RGPD) and Organic Law 3/2018 of 5 December on the Protection of Personal Data and guarantee of digital rights, and the rights that assist Users in accordance with the privacy policy of this Website.

Duration of courses

Group courses will be, by default, 10 weeks long. Otherwise, the duration will be agreed with the students.

Material

The material chosen for the course will be paid for by the students. In case it cannot be found by other means, it may be requested through the teacher. The cost of the material will be paid at the moment of receiving it. In most cases, the same material can be used in several consecutive 10-week courses.

Contents

In all courses we will work with the competency-based approach (reading, writing, listening and speaking), with special emphasis on the oral communicative approach.

Adult courses

The contents of the courses will be those established by the Common European Framework.

In the case of special courses, the contents may be agreed upon with the students.

Spanish, language of heritage.

A program for each course and level will be prepared at the beginning of the course.

Levels.

In the case of new students, the management reserves the right to conduct a placement test before or at the beginning of the course to ensure that you are at the appropriate level.

Payments.

Payments will be made when registering for the course through the web page. In the case of an invoice, payment will be made within 30 days of the payment notice.

Absences

Group classes:

If the teacher is unable to attend the class, the students will be informed and a new date will be set with the group to make up the class. An attempt will be made to extend the duration of the course for another week at the same time. If this is not possible, another date will be arranged with the students to make up the class.

 

Private/individual classes:

If the teacher is unable to attend the class, he/she will notify the student as soon as possible.

If the student is absent, he/she must inform the teacher at least 24 hours before the lesson in order not to miss the class.

In case of 3 or more absences in a package of 10 classes, the teacher reserves the right to rearrange the schedule and give priority to another student on the waiting list.

Events:

Case 1: AW. If the student finally cannot attend the event, he/she must communicate his/her absence 48h before the event and his/her place will be saved for the next AW. Only for the next AW, places will not be saved for subsequent events.

Case 2: Other events. In the case of workshops, one-day events, book clubs… the registration fee will not be kept or refunded.

Returns

A refund of the total course fee may be requested within 10 days of the start of the course.

4. WRITTEN COMMUNICATIONS AND NOTIFICATIONS

By using this Web Site, the User accepts that most of the communications with Cháchara will be electronic (e-mail or notices published on the Web Site).

For contractual purposes, the User consents to use this electronic means of communication and acknowledges that all contracts, notifications, information and other communications that Cháchara sends electronically comply with the legal requirements of being in writing. This condition will not affect the rights recognized by law to the User.

The User can send notifications and/or communicate with Cháchara through the contact details provided in these Conditions and, where appropriate, through the contact spaces on the Website.

Likewise, unless otherwise stipulated, Cháchara may contact and/or notify the User by e-mail or at the postal address provided.

5. WAIVER

No waiver by Cháchara of any specific legal right or action or failure by Cháchara to require strict compliance by the User with any of its obligations shall constitute a waiver of any other right or action arising from a contract or the Conditions, nor shall it exonerate the User from compliance with its obligations.

No waiver by Cháchara to any of these Conditions or to the rights or actions arising from a contract shall be effective, unless it is expressly stated that it is a waiver and it is formalized and communicated to the User in writing.

6. NULLITY

Should any of these Conditions be declared null and void by a final decision issued by a competent authority, the rest of the clauses shall remain in force, without being affected by such declaration of nullity.

7. COMPLETE AGREEMENT

The present Conditions and any document to which express reference is made in these constitute the entire existing agreement between the User and Cháchara in relation to the object of the sale and purchase and replace any other previous pact, agreement or promise agreed verbally or in writing by the same parties.

The User and Cháchara acknowledge having consented to the conclusion of a contract without having relied on any statement or promise made by the other party, except for what is expressly mentioned in these Conditions.

8. DATA PROTECTION

The information or personal data that the User provides to Cháchara in the course of a transaction on the Website, will be treated in accordance with the provisions of the Privacy Policy or data protection (contained, where appropriate, in the Legal Notice and General Conditions of Use). By accessing, browsing and/or using the Web Site the User consents to the processing of such information and data and declares that all information or data provided are truthful.

9. APPLICABLE LAW AND JURISDICTION

Access to, browsing and/or use of this Web Site and contracts for the purchase of products through the same shall be governed by Spanish law.

Any controversy, problem or disagreement arising out of or related to the access, navigation and/or use of the Web Site, or the interpretation and execution of these Conditions, or the sales contracts between Cháchara and the User, shall be submitted to the non-exclusive jurisdiction of the Spanish courts and tribunals.

10. COMPLAINTS AND CLAIMS

The User can send to Cháchara their complaints, claims or any other comment they wish to make through the contact details provided at the beginning of these Conditions (General Information).

In addition, Cháchara has official complaint forms available to consumers and users, which they can request from Cháchara at any time, using the contact information provided at the beginning of these Conditions (General Information).

Also, if a dispute arises from the conclusion of this purchase contract between Cháchara and the User, the User as a consumer may request an out-of-court dispute resolution, in accordance with Regulation (EU) 524/2013 of the European Parliament and of the Council of 21 May 2013 on the settlement of consumer disputes online and amending Regulation (EC) 2006/2004 and Directive 2009/22/EC.
